Collection of personal information

SHREDSTATION collects and uses personal information to understand your needs and interests and to serve you better. On some SHREDSTATION websites, we ask you to provide personal information. For example, when you order our services, request information, subscribe to marketing or support materials, register yourself for SHREDSTATION accounts, or apply for a job at SHREDSTATION, we will ask you to provide personal information to complete these transactions. ShredStation, Inc. or any of its subsidiaries will not sell, rent or lease your personal information to others. ShredStation shares personal information with companies working on our behalf and ShredStation-owned business entities.

ShredStation retains service providers and suppliers to deliver complete products, services and customer solutions and to assist ShredStation with marketing and communication initiatives. Suppliers and service providers are required by contract to keep confidential the information received on behalf of ShredStation and may not use it for any purpose other than to carry out the services they are performing for ShredStation.

If you choose to provide personal information only to SHREDSTATION and not its marketing partners, SHREDSTATION will not share this information with the other companies participating in that marketing initiative. It is SHREDSTATION’s practice to seek appropriate protection for information in these types of transactions.

Credit Card Authorization Policy

Like many companies that wait until after services have been rendered to bill its’ customers, SHREDSTATION reserves the right to pre-authorize a customer’s credit card. Since SHREDSTATION manages the pick-up and delivery of boxes for shipment that may have been inadvertently misjudged in size or weight upon the initial order, SHREDSTATION must authorize its customers’ credit cards based on the maximum size and weight amount for any given transaction. This ensures that SHREDSTATION receives the appropriate financial compensation associated with the amount of materials picked up and destroyed.

Children’s privacy

SHREDSTATION does not knowingly collect information from children under the age of 15 and does not target its websites to children under 15. We encourage parents and guardians to take an active role in their children’s online activities and interests.

Your choices and selecting your privacy preferences

SHREDSTATION gives you the choice of receiving a variety of information that complements our products and services. You can subscribe to receive certain product- and service-specific information and also choose to receive SHREDSTATION general communications. We give you a choice regarding delivery of SHREDSTATION general communications by postal mail, email and telephone.

You can make or change your choices about receiving either subscription or general communications at the data collection point or by using other methods, which are listed in the following sections. SHREDSTATION general communications

SHREDSTATION account registration is a single-login service that lets you register with SHREDSTATION account-enabled websites using a single-user identifier and password of your choice. SHREDSTATION accounts use cookies to store your basic personal information so you don’t have to retype it when you return to one of SHREDSTATION’s many websites in the future.

Access to and accuracy of your information

SHREDSTATION strives to keep your personal information accurately recorded. We have implemented technology, management processes and policies to help maintain data accuracy. Keeping your information secure

SHREDSTATION takes personal privacy very seriously. To prevent unauthorized access or disclosure, to maintain data accuracy, and to ensure the appropriate use of the information, SHREDSTATION utilizes appropriate physical, technical and administrative procedures to safeguard the information we collect.

We use Secure Sockets Layer (SSL) encryption when collecting or transferring sensitive data such as credit card information. SSL encryption is designed to make the information unreadable by anyone but SHREDSTATION. This security measure is working when you see the symbol of either an unbroken key or a closed lock (depending on your browser) at the bottom or top of your browser window. Credit card numbers are used only for processing payments and are not used for other purposes. As part of real-time payment processing, SHREDSTATION subscribes to a fraud management service. This service gives you and SHREDSTATION an extra level of security to guard against credit card fraud and to protect your financial data.

Legal Terms

Limited Warranty. Customer agrees that ShredStation’s responsibility to Customer under this Agreement is limited to the exercise of ordinary care. EXCEPT AS PROVIDED IN THIS SECTION, SHREDSTATION MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, NATURE OR DESCRIPTION, EXPRESS OR IMPLIED, WITH RESPECT TO ITS SERVICES, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE AND SHREDSTATION HEREBY DISCLAIMS THE SAME.

Limitation of Liability. In the event of any failure or delay in the performance of the services in accordance with this Agreement, ShredStation’s liability shall be limited to the fee paid by Customer for the particular service. In no event shall ShredStation’s liability exceed an amount equal to the fees paid hereunder for the 12-months immediately prior to the date of Customer’s claim. In no event shall ShredStation be liable to Customer, whether in contract or in tort, or under any other legal theory(including, without limitation, negligence or strict liability) for lost profits or revenues, loss of use or similar economic loss, or for any indirect, special, incidental, consequential or similar damages arising out of or in connection with this Agreement or the services to be provided hereunder, or for any claim made against Customer by any other person, even if ShredStation has been advised of the possibility of such claim. Any insurance which may be carried by either ShredStation or Customer against any loss or damage shall be for the sole benefit of the party maintaining such insurance.

Confidentiality. ShredStation will use commercially reasonable efforts to hold confidential all information obtained by it with respect to Customer and the Customer Materials. Security measures will be in place to reasonably ensure the security of the Customer Materials from the time ShredStation takes possession of the containers, during transfer and transport, until the Customer Materials are ultimately destroyed.

Limitation of Actions. Any claim by Customer with respect to the services to be performed by ShredStation hereunder must be made in writing to ShredStation within two years after the date those facts underlying the such claim arose. No other action, regardless of form, arising out of or in connection with this Agreement (other than an action by ShredStation for any amount due toShredStation) may be brought more than two years after the date those facts underlying the such claim arose.

Indemnification. Customer shall defend, indemnify and hold harmless ShredStation and its officers, directors, employees and agents against any liability, cost or expense (including court costs and reasonable attorneys’ fees), other than bodily injury, irrespective of the theory on which any such claim is based (including, without limitation, negligence or strict liability), directly or indirectly arising out of third party claims, demands or actions relating to (a) ShredStation’s possession or destruction of Customer Materials, or (b) Customer’s breach of this Agreement, unless, in either case, caused by the gross negligence or willful misconduct of ShredStation.

Force Majeure. ShredStation shall not be liable for any default or delay in the performance of any of its obligations under this Agreement if caused, directly or indirectly, by fire, flood, earthquake, the elements, or other such occurrences; labor disputes, strikes or lockouts; wars, riots or civil disorder; accidents or unavoidable casualties; interruptions of or delays in transportation or communications; decisions or requirements, whether valid, invalid, formal or informal, of any government, agency, board or official; or any other cause, similar to those enumerated herein, beyond ShredStation’s reasonable control.

Miscellaneous. (a) Customer shall not assign all or any portion of this Agreement without the prior written consent of ShredStation. (b) No failure or delay by ShredStation to exercise any right or remedy hereunder shall operate as a waiver thereof, nor shall any single or partial exercise of any right or remedy by ShredStation preclude any further exercise thereof or the exercise of any other right or remedy. No express waiver by ShredStation to any breach of this Agreement shall constitute a waiver of any other prior or succeeding breach. (c) This Agreement shall be governed by the laws of the State of California, without regard to its principles of conflicts of law. (d) Headings describing the contents of particular sections are inserted only for convenience and shall not be construed as a part of this Agreement. (e) This Agreement and the Schedules attached supersede all prior discussions and agreements between the parties with respect to the subject matter hereof, and contains the sole and entire agreement between the parties with respect to the matters covered hereby. (f) This Agreement may not be modified or amended except by an instrument in writing signed by the parties. (g) If any provision of this Agreement is held by a court of competent jurisdiction to be invalid, void or unenforceable, the remainder of the provisions hereof shall remain in full force and effect. (h) Except as otherwise provided in this Agreement, all notices under this Agreement shall be in writing and delivered personally or sent by pre-paid, first class, certified or registered air mail, return receipt requested, or by telecopy to the intended recipient at its address or telecopy number set out on the reverse side (or to such other address or telecopy number as a party may from time to time duly notify the other).
